On Your Markus: standard terms for all competitions and giveaways
1. About these terms
These terms apply to every competition, giveaway and prize draw ("Competition") run on onyourmarkus.au.
By entering a Competition you accept these terms and any additional details set out on the individual Competition page ("Competition Page") — including the prize, its retail value, the entry period and the draw date. Where a Competition Page says something different from these terms, the Competition Page wins.
If you don't accept these terms, don't enter.
2. The promoter
The promoter is Markus Hamence trading as On Your Markus, South Australia ("we", "us", "On Your Markus").
You can contact us at onyourmarkus.au/contact/ with any question about a Competition.
Our Competitions are minor trade promotions under the Lotteries Act 2019 (SA). Where a Competition requires a trade promotion lottery licence, the licence number will be shown on the Competition Page.
3. Who can enter
Entry is open to residents of Australia, unless the Competition Page says otherwise.
You must be 18 or older to enter. If you're under 18, you may only enter with the permission of a parent or guardian, and we may require your parent or guardian to accept the prize on your behalf and to confirm their consent before we award it.
The following people can't enter: employees, contractors and immediate family of On Your Markus, and of the venue, promoter, producer or other provider of the prize.
Some prizes are age-restricted by law or by the venue (for example, events at licensed premises). If you can't lawfully attend or accept a prize, you can't win it.
4. How to enter
Enter by completing the entry form on the Competition Page before the closing time stated there. Entry is free — no purchase or payment of any kind is required or accepted.
All times shown are Adelaide time (ACST or ACDT, whichever is in force).
An entry is valid only if it is complete, accurate, submitted through the entry form, and received before the closing time. Entries that are incomplete, illegible, automated, or submitted by any means other than the entry form are invalid.
One entry per person, per Competition, unless the Competition Page states otherwise.
To keep the draw fair, we use automated checks to identify duplicate and non-genuine entries. These checks may treat different-looking email addresses as the same person (for example, by ignoring full stops and "+" tags in an address), and we may reject entries made using disposable or temporary email services. Where we identify more than one entry from the same person, only the earliest valid entry is counted — the rest are disregarded.
We may verify any entry, and may disqualify entries that we reasonably believe are duplicated, automated, fraudulent, made using a false identity, or otherwise not in the spirit of the Competition.
We aren't responsible for entries that are lost, delayed, corrupted or not received for any reason, including technical failure.
5. The draw
Winners are chosen at random from all valid entries, using the random draw tool built into our site, after the Competition closes. The draw date is shown on the Competition Page.
The number of winners and the prize each will receive are as stated on the Competition Page.
6. Winners — notification, publication and claiming
Notification. We'll contact each winner by email, at the address given on entry, within 14 days of the draw. It's your responsibility to give us a valid email address and to check it.
Publication. We may publish the first name and suburb of each winner on onyourmarkus.au and on our social media. By entering, you agree to this. If you'd rather not be identified, tell us before the draw and we'll discuss alternatives — but we may not be able to award you the prize if we can't meet our obligations to publish.
Claiming. A winner must respond and provide any details we reasonably need (for example, the name for a ticket booking) within 14 days of being notified — or within a shorter period stated on the Competition Page, where the event date makes that necessary. Because our prizes are usually tickets to events happening soon, some Competitions have a short claim window. That window will always be stated on the Competition Page before you enter.
Unclaimed prizes. If a winner doesn't respond within the claim window, can't be contacted, is ineligible, or declines the prize, we may redraw and award the prize to another valid entrant. We may repeat this as often as necessary.
7. Prizes
The prize for each Competition, and its retail value, are stated on the Competition Page. Prize values are in Australian dollars and include GST.
Prizes:
are not transferable and cannot be exchanged for cash or any other prize;
may be substituted for a prize of equal or greater value if the advertised prize becomes unavailable for reasons outside our control;
are subject to the terms and conditions of the venue, event promoter and ticketing agent, which you must comply with.
Where the prize is event tickets, you are responsible for your own transport, accommodation, food, drink and any other cost not expressly included in the prize. Fulfilment (for example, issuing tickets or putting you on a door list) may be handled by the venue, event promoter or prize provider rather than by us.
We are not responsible if an event is cancelled, postponed, rescheduled or changed, or if a performer doesn't appear. In that situation the prize is subject to whatever the venue or event promoter decides, and we're not required to provide a replacement or compensation.
Any tax consequences of accepting a prize are the winner's responsibility. We recommend you get independent advice if you're unsure.
8. Your personal information
We collect your name and email address so we can run the Competition — to check your entry is valid, to run the draw, and to contact you if you win. We also record technical information (such as your IP address and the time of entry) to detect duplicate and automated entries.
We handle your information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We never sell entrant details.

9. The newsletter is optional
The entry form includes an optional tick-box to subscribe to the On Your Markus newsletter.
Subscribing is not a condition of entry. You can enter every Competition without ticking it, and your chance of winning is exactly the same either way.
If you do tick it, we'll add your email address to our newsletter list and send you reviews, tour news and giveaways. You can unsubscribe at any time with one click from any email we send.
10. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.
Subject to that, and to the extent permitted by law, we're not liable for any loss, damage, injury or expense arising out of a Competition, your entry, or your acceptance or use of a prize.
11. General
We may verify the eligibility of any entrant and may disqualify any entry, or any entrant, where we reasonably believe these terms have been breached.
We may amend, suspend or cancel a Competition where necessary for reasons outside our reasonable control, subject to any law that prevents us from doing so.
Where a Competition is promoted on Facebook, Instagram or any other social platform, it is in no way sponsored, endorsed, administered by, or associated with that platform. Any information you provide is provided to us, not to the platform.
Subject to the rights you have under law, our decision on any matter concerning a Competition is final and we won't enter into correspondence about it.
These terms are governed by the laws of South Australia.
